We decide how and why your personal data is used, which makes us the controller of that data. If you have any question about this policy or your data, email us at hello@bamfxstudio.com. We read every message.
Here’s what we collect, why we need it, the legal basis we rely on, and how long we keep it.
| What | Why we use it | Legal basis | How long we keep it |
|---|---|---|---|
| Messages you send us: your name, email, company and what you write, through the contact form, quick chat, email or social media | To reply and talk about your project | Our legitimate interest in answering you, or steps you ask for before a contract | 24 months after your last message, unless you become a client |
| Project briefs and orders: your name, work email, app name and link, goals and chosen plan | To set up your project and plan | Performing our contract with you | While you’re a client and 3 years after your last project |
| Client account: name, email, company, role, password (stored securely, never in plain text), log in methods, the devices and times you log in, and your notification settings | To run your account and keep it secure | Performing our contract, and our legitimate interest in security | Until you close your account. Security logs for 12 months |
| Project materials: brand files, app screenshots, footage, feedback, messages and the ads we deliver | To make, revise and deliver your ads | Performing our contract with you | 12 months after your last project, then deleted, except ads in our portfolio, unless you’ve asked us not to show them |
| Payment records: billing name and email, plan, amounts, dates, payment method type, the last 4 card digits shared by the bank, and transaction IDs | To take payments, keep accounts and prevent fraud | Performing our contract, and legal obligations under tax and accounting law | As long as tax and accounting law requires |
| Reviews: your rating, review, display name, company and role, and whether you agreed to publication | To publish your review if you agreed, and to improve our work | Your consent for publishing. Our legitimate interest for private feedback | Published reviews until you ask us to remove them. Private feedback for 3 years |
| Website and security data: IP address, browser and device type, pages requested, date and time, and the referring page | To deliver the website, keep it secure and stop abuse | Our legitimate interest in running a safe website | Kept by our hosting provider for a short period under its own policy |
You don’t have to give us any personal data, but without it we can’t reply to you, take your order or make your ads.
We don’t use your data to make automated decisions that have legal or similarly significant effects on you, and we don’t collect sensitive data such as health or biometric information. Please don’t send us any.
When you pay by card, Apple Pay or Google Pay, you complete the payment on the secure payment page of our bank, [PAYMENT BANK]. Your full card number and security code go straight to the bank and are never shared with us. For monthly plans, the bank keeps a secure token of your card so it can charge your renewals. We can’t see or use your card number. The bank, and Apple or Google if you use their wallets, process your payment data under their own privacy policies.
We’re based in [COUNTRY OF REGISTRATION] and work with clients around the world. Some of our providers store or process data in other countries, including EU countries and the United States. When personal data goes to a country that isn’t recognized as giving adequate protection, we rely on the safeguards the law allows, such as the EU US Data Privacy Framework or the standard contractual clauses in our providers’ data processing terms. Contact us if you’d like more detail.
You can ask us to:
Email hello@bamfxstudio.com to use any of these rights. We’ll reply within 10 working days. If we need more time, we can extend that once by up to 10 working days, and we’ll tell you why. We may ask you to confirm your identity first. If we can’t do what you ask, for example because the law requires us to keep certain records, we’ll explain why.
You can also complain to the data protection authority in [COUNTRY OF REGISTRATION], or to the authority in the country where you live or work. We’d appreciate the chance to fix things first, so please contact us before you do.
We only send news and offers if you’ve agreed to receive them. Every marketing email has an unsubscribe link, and you can also just reply and ask. We stop within 7 working days. Emails about your projects, account and payments aren’t marketing, so you’ll keep getting those while you’re a client.
We use encrypted connections across the whole website, two step verification on our own accounts, and access only for people who need it. Card payments are handled entirely by our bank. No system is perfectly secure. If a breach ever happens, we’ll notify the data protection authority within 72 hours unless it’s unlikely to cause harm, and if it’s likely to put your data at serious risk, we’ll tell you without delay.
Our services are for businesses and aren’t meant for anyone under 18. We don’t knowingly collect data from anyone under 18. If you think a child has sent us personal data, contact us and we’ll delete it.
We’ll update this policy when our services or the law change. The date at the top shows the latest version. If a change matters for how we use your data, we’ll tell clients by email before it takes effect.
