About these terms
These terms are the agreement between you and BAM FX Studio, a trading name of [LEGAL BUSINESS NAME], registration number [REGISTRATION NUMBER], registered at [REGISTERED BUSINESS ADDRESS], [COUNTRY OF REGISTRATION] (“we”, “us”, “the studio”). They cover our website, client accounts and every plan we sell.
Our services are for businesses. You accept these terms when you tick the box at checkout, create an account or start a project with us, and if you act for a company, you confirm you’re allowed to accept them for it. If you only browse our website, the section on using our website applies to you. If we agree a written proposal or quote with you, it takes priority over these terms where the two differ.
Our plans
We make short video ads for subscription apps. All prices are in US dollars.
| Plan | Price | What’s included |
|---|
| Test Pack | $450, one time | 3 ads: 1 concept with 3 hook versions, delivered within 5 business days |
|---|
| Starter | $1,350 a month | 6 new ads a month: 2 concepts with 3 hook versions each, in one monthly batch |
|---|
| Growth | $2,400 a month | 12 new ads a month: 4 concepts with 3 hook versions each, in 2 batches a month, plus a monthly results review |
|---|
| Scale | $4,200 a month | 24 new ads a month: 6 concepts with 4 hook versions each, delivered weekly, plus a monthly results review |
|---|
Every ad comes in 9:16 and 4:5. Scale also includes 1:1 and 16:9. Extra ads, other formats and special projects are quoted separately before we start.
Each monthly plan covers a set number of new ads per billing month. If you don’t use your full number of ads in a billing month, the rest don’t roll over, unless the delay was on our side. If you need more time, ask us before the month ends and we’ll do our best to help.
Payments and billing
- You pay in advance by card, Apple Pay or Google Pay on our bank’s secure payment page. We never see or store your card details.
- Monthly plans renew automatically on the same date each month and are charged to your saved payment method until you cancel.
- The Test Pack is a one time payment. If you start a monthly plan within 30 days of your Test Pack delivery, we take $450 off your first month.
- Prices don’t include taxes that may apply where you are. If we’re ever required to charge tax, we’ll show it before you pay. We don’t add card fees, but your own bank may charge currency conversion fees.
- If a payment fails, we’ll let you know and may pause work until it goes through.
- We may change prices for future billing months. We’ll email you at least 30 days before a change affects your plan, and you can cancel before it does.
Pausing, switching and cancelling
- You can pause, switch or cancel your plan at any time before your next billing date, from your dashboard or by emailing us.
- A pause skips the next billing month. You’re not charged for it and no new ads are made that month. Your plan picks up again at the start of the following month.
- A plan switch starts on your next billing date.
- When you cancel, your plan stays active until the end of the month you’ve paid for, then stops. You keep every ad we’ve delivered.
Refund policy
- If you cancel a Test Pack or a new plan before we’ve started any work on it, we refund you in full.
- Once work has started, payments aren’t refundable, because the time and production for that month are already committed. Work counts as started once we begin your concepts or scripts.
- The same applies to monthly renewals: if you meant to cancel and we haven’t started that month’s work yet, tell us and we’ll refund the renewal.
- If we fail to deliver the ads your plan includes in a billing month and can’t make them up within the following 30 days, we refund the part of that month’s payment that covers the missing ads.
- We don’t give partial refunds for unused time after you cancel.
- Refunds go back to your original payment method, usually within 5 to 10 business days, depending on your bank.
If something isn’t right, please email hello@bamfxstudio.com before disputing a charge with your bank. We’ll do our best to sort it out quickly.
How we work and deliver
- After you pay, we ask for a short brief and your brand files. Delivery times start once we have them.
- Your first ads land within 5 business days. After that, monthly plans follow the schedule above.
- Everything is delivered digitally, as video files in your client dashboard or through a download link. Nothing is shipped.
- We’ll keep you posted in your dashboard or by email. If something on our side delays a delivery, we’ll tell you as early as we can.
Feedback and revisions
- Every ad includes 2 rounds of revisions. A round means one set of combined feedback on that ad.
- Please send feedback within 14 days of a delivery. If we don’t hear from you by then, we treat the ad as approved, though we’ll still fix genuine errors on our side.
- If a concept misses the brief completely, we rework it without using up your revisions.
- Changes that go beyond the original brief, such as a new script or a new concept, count as a new ad.
Who owns the ads
- Once you’ve paid for an ad, we transfer to you all our property rights in it, exclusively, worldwide, for every use and for the full term of copyright, including the right to edit it. Run it as a paid ad or organic post, on any platform, for as long as you like. As far as the law allows, we won’t use our personal rights as authors to object to how you use or edit it.
- Licensed music, stock footage, sound effects, fonts and creator or actor appearances stay owned by their creators and follow the license terms we confirm before production. Our standard licenses cover paid and organic social media ads. Don’t reuse those elements on their own outside the ad.
- We keep ownership of our own tools, templates, methods and project files. Editable project files aren’t included unless we agree it in writing.
- If you haven’t paid for an ad, all rights in it stay with us until you do.
Your materials and your claims
- You confirm that you own, or have permission to use, everything you send us, such as logos, screenshots, footage, music, reviews and testimonials. You let us use it to make your ads.
- You approve every ad before you run it, and you’re responsible for the claims it makes about your app, for example about health, money or results, and for following ad platform policies and the law where you advertise.
- We can refuse work that we believe is unlawful, misleading or harmful.
- If you send us personal data about other people, for example people who appear in your footage or testimonials, we process it only to make your ads, keep it confidential and secure, and delete it when your project ends unless you ask us to keep it. You’re responsible for having the right to share it with us.
AI, creators and actors
- Some ads use AI generated visuals, voices or people. We’ll tell you which ones do, so you can apply any labels the ad platforms or local laws require.
- We never create an AI likeness of a real person without their written permission.
- If an ad features a real creator or actor, their usage rights cover paid social ads on the platforms and for the period we confirm in writing before production. Wider use, such as TV or billboards, needs a separate agreement.
Portfolio and confidentiality
- We keep your unreleased plans, data and materials confidential and only use them to make your ads.
- Once an ad is public, we may show it in our portfolio and on our social media. If you’d rather we didn’t, just tell us and we won’t.
Results
We make every ad to perform, but we can’t guarantee results such as installs, trial starts, cost per result or return on ad spend. Those depend on your app, offer, targeting, budget and the platforms themselves, which are outside our control.
Client accounts
- Keep your log in details safe and don’t share your account. You’re responsible for what happens under it.
- Tell us straight away if you think someone else has accessed your account.
- We may suspend an account that’s used to break these terms or put the service at risk.
Using our website
- Please use the website lawfully. Don’t try to break its security, overload it, or copy large parts of it by automated means.
- Everything on the website, including our ads, designs and text, belongs to us or our licensors. The hooks in the Hook lab are free to use as inspiration for your own ads.
- Links to other websites are there for convenience. We’re not responsible for their content.
Reviews
If you send us a review and agree that we can publish it, we may show it on our website and social media with the name, company and role you chose. We show reviews word for word and never change what you wrote. You can ask us to remove your review at any time.
Liability
- We provide our services with reasonable skill and care.
- We’re not liable for indirect or consequential losses, such as lost profits, lost revenue, wasted ad spend or loss of data.
- Our total liability for all claims together is limited to the amount you paid us in the 3 months before the first claim arose.
- Nothing in these terms limits liability that can’t be limited by law, such as liability for fraud, intent or gross negligence.
- You agree to cover our reasonable losses if a third party makes a claim against us because of materials you supplied or claims you approved in your ads.
- Neither of us is responsible for delays caused by events outside our reasonable control.
Ending the agreement
You can stop working with us at any time by cancelling your plan. We can end or suspend our services if you don’t pay, or if you seriously break these terms and don’t fix it within 14 days of us asking. The sections on ownership, payments, confidentiality and liability continue after the agreement ends.
Governing law and disputes
These terms are governed by the laws of [COUNTRY OF REGISTRATION]. If a dispute comes up, we’ll first try to solve it together in good faith. If we can’t, the courts of [CITY], [COUNTRY OF REGISTRATION] will decide it.
Changes to these terms
We may update these terms from time to time. The date at the top shows the latest version. If a change affects your plan, we’ll email you at least 14 days before it takes effect, or 30 days for price changes. If you don’t agree, you can cancel before then.
